Background: SB55 would invalidate the use of any out-of-state driver’s license where the state did not require the license holder to show proof of lawful presence in the United States to receive the license. This bill would also prevent nonresidents holding such licenses from qualifying for Alabama’s driver’s license exemption, meaning they would be required to obtain an Alabama license if they wished to drive in the state. Law enforcement officers stopping an individual with an affected license would be required to issue a citation for driving without a license. 

Our Position: We oppose SB55. This bill serves no legitimate purpose, as driver’s license requirements across the country already include legal presence verification. It could lead to racial profiling, disrupt lawful travel, and create unnecessary barriers for immigrants and nonresidents. Rather than targeting individuals based on their home state’s licensing policies, Alabama should focus on policies that promote fairness and equal treatment under the law.
