For several years, the St. Clair County Jails prohibited attorneys from having contact visits with their clients at either of the County’s jails. Rather, they would have to use the public facilities requiring them to talk through glass with a phone. The set up lacked any privacy. In addition, a sign was posted stating that all calls were recorded.
Following authorization by the Legal Committee for a challenge to these policies, we sent a detailed letter to the Sheriff outlining why we believed that these policies were unconstitutional. We have now confirmed that a new notice has been posted at the jails advising that attorneys are to use a certain area but if an office is needed to meet privately with the client, an office will be provided. Thus, litigation is not necessary.
