Background: Under current Alabama law, the only method for an elector to vote before Election Day is via absentee ballot, which requires meeting specific eligibility criteria. HB 71 would establish an early voting process for general and special elections, excluding municipal elections. The bill mandates a minimum number of early voting centers per county, establishes prescribed hours of operation, and allows electors to vote early using a voting machine without requiring an excuse. County commissions would be responsible for designating early voting locations, publicizing their availability, and ensuring that early voting procedures align with Election Day regulations. The bill also requires the Secretary of State to adopt rules to prevent duplicate voting. 

Our Position: The ACLU of Alabama supports HB 71. Early voting improves accessibility to the ballot box, particularly for voters with inflexible work schedules, transportation challenges, or other responsibilities. Expanding early voting reduces congestion on Election Day, shortens wait times, and enhances the accuracy of election administration by allowing officials to identify and address potential issues before the final day of voting. Furthermore, early voting has been shown to increase voter participation and provide greater flexibility, ensuring that all eligible Alabamians can exercise their right to vote. Furthermore, most Alabamians want early voting.
